Terms of Service

Welcome to GetItDone ("the Service"), operated by Pinch Africa ("we", "us", "our"). By accessing or using GetItDone you agree to these Terms of Service. If you do not agree, please do not use the Service.

1. Accounts

You must provide accurate information when registering. You are responsible for safeguarding your password and for all activity under your account. You must notify us immediately of any unauthorised access. You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service.

2. Subscriptions and billing

GetItDone is offered on subscription plans billed monthly or annually in Kenyan Shillings (KES) or such other currency as we may make available. By starting a paid plan you authorise us, through our payment processor (Paystack), to charge the payment method on file on each renewal date until the subscription is cancelled.

  • Renewals. Subscriptions renew automatically unless cancelled before the renewal date.
  • Refunds. Fees are non-refundable except where required by law. You may cancel at any time and continue to use paid features until the end of the current billing period.
  • Upgrades and downgrades. Plan changes take effect immediately. Upgrades are pro-rated; downgrades take effect at the next renewal.
  • Failed payments. If a charge fails, we will retry, and may suspend access if the failure is not resolved within 7 days.
  • Taxes. Prices are exclusive of applicable taxes, which you are responsible for.

3. Acceptable use

You may not, and must not allow others to: (a) use the Service for unlawful purposes; (b) infringe intellectual property; (c) attempt to break, probe, or reverse-engineer the Service; (d) send spam or unsolicited communications; (e) upload malware; (f) impersonate others; (g) resell or sublicense the Service without our written consent.

4. Your content

You retain ownership of all content you upload, create, or store in GetItDone ("Customer Data"). You grant us a limited licence to process Customer Data only as needed to provide and improve the Service. We do not sell Customer Data and we do not use it to train third-party AI models without your explicit consent.

5. Our intellectual property

The GetItDone software, brand, logos, and design are owned by Pinch Africa and protected by copyright, trademark, and other laws. We grant you a limited, non-transferable, non-exclusive licence to use the Service for the duration of your subscription.

6. Suspension and termination

We may suspend or terminate your access if you breach these Terms, fail to pay fees, or use the Service in a way that puts other users or our infrastructure at risk. You may terminate your account at any time by cancelling your subscription and deleting your workspace. On termination we will retain Customer Data for up to 30 days, after which it will be permanently deleted.

7. Service availability

We aim for high availability but do not guarantee the Service will be uninterrupted or error-free. Scheduled maintenance will be communicated when possible.

8. Disclaimers and liability

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied. Our total liability for any claim arising out of or relating to the Service is limited to the fees you paid in the 12 months preceding the claim.

9. Indemnity

You agree to indemnify and hold us harmless from any claim arising out of your Customer Data, your use of the Service, or your breach of these Terms.

10. Governing law

These Terms are governed by the laws of the Republic of Kenya. Any dispute will be resolved in the courts of Nairobi, Kenya, unless you and we agree otherwise.

11. Changes

We may update these Terms from time to time. Material changes will be communicated by email or in-app notice at least 14 days before they take effect. Continued use of the Service after the effective date means you accept the updated Terms.
